KICKS CREW (“we,” “us,” or “our”) reserves the right to modify these Terms and Conditions at any time to reflect changes in market conditions, technology, payment methods, relevant laws, regulatory requirements, or updates to our system capabilities. We may also make changes for any other reason at our sole discretion.

These terms apply to all users of our website (“Site”), mobile applications (“Apps”), or any other service that links to these terms (collectively, the “Services”). You agree to be bound by these Terms by using or accessing our Services. If you disagree, you may not use or access the Services.

The terms in effect at the time of your order will apply unless changes are required by law or regulatory authority, in which case the new terms may apply to orders already placed. If we notify you of any updates to these Terms before sending a shipment confirmation, we will assume your acceptance unless you inform us otherwise.

BY ACCESSING OR USING OUR SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OR ACCESS OUR SERVICE.

Payment Method

We offer a wide range of payment options to ensure a seamless shopping experience. Currently, KICKS CREW accepts the following payment methods:

  • Credit/Debit Cards: Visa, Mastercard, American Express, Discover, JCB, Diners Club, Union Pay
  • Digital Wallets: Google Pay, Apple Pay, Cash App Pay, PayPal
  • Installment Payments: Affirm, Afterpay, Klarna

Payment options may vary depending on your location, and specific terms and conditions may apply to each payment provider.

KLARNA

Klarna offers flexible payment methods, such as Buy Now and Pay Later, giving you more control over how and when you pay. Eligibility requirements and available payment options vary by region. During checkout, you’ll be redirected to Klarna to select a payment option. Klarna may perform a soft credit check, which will not affect your credit score. Pricing

KICKS CREW operates as a platform, and therefore, prices are subject to periodic adjustments. The final price, including any applicable taxes and shipping fees, will be confirmed at checkout.

Please note that product prices may vary based on factors such as supplier costs, currency exchange rates, and market conditions. While we strive to maintain accurate and competitive pricing, occasional discrepancies may occur.

We currently do not offer a Best Price Guarantee or Price Matching policy.

Product Information

We have taken reasonable measures to represent products as accurately as possible. However, please note that product appearance may vary due to factors such as photographic lighting sources, monitor resolution, or related device settings.

If you have any concerns regarding the size, color, appearance, or model number of a product, we recommend contacting us before placing an order.

Order

The maximum order quantity is 1 unit per order, as items may come from different suppliers. All orders are subject to availability, and items in your shopping cart are not reserved until checkout is completed.

To place an order, you must provide accurate information, including your full name, phone number, email address, and any other required details. We reserve the right to cancel your order for the following reasons:

  • The product is not available/in stock
  • Incorrect or unverifiable billing information
  • Security concerns or suspected fraud
  • Payment not received within 7 days
  • Pricing errors on the site
  • Delivery issues with the provided address
  • Events beyond our control

Once an order is placed, details cannot be amended, but you may request a cancellation before shipment. Cancellation requests are not guaranteed, and a 25% cancellation fee will apply if approved. If cancellation is not possible, your order will proceed as usual.

Discount and Voucher

  • All offered codes are applied to the value of the order (product price), excluding delivery costs, and are subject to our shipping information.
  • The offered code must be entered in the Voucher Code field on the checkout page during the order process.
  • Coupon codes cannot be combined, and only one code can be applied per order. 
  • Promotional Experience Days are excluded from offers unless otherwise stated.
  • Price-reduced items (displaying a 'Was' and 'Now' price) are also excluded from voucher offers.
  • In the event of a product return, the refund will be based on the value of the original purchase, i.e., with the applied discount, not at the item's Recommended Retail Price (RRP).
  • In the event of a product exchange (e.g., for a different size), any currency or potential price difference will be based on the value of the item(s) at the time of the transaction, i.e., with the discount applied. However, please note that discounts will not be eligible for the new size/replacement order.
  • Discount codes and vouchers do not apply to shipping fees.
  • Any price difference or remaining amount of the discount and voucher code used in the purchase is non-refundable.
  • KICKS CREW reserves the right to vary or discontinue the Discount Voucher code at any time without notice.

Risk and Fraud Control

We may request customer information when abnormal activity is detected in relation to their payment details, which could indicate potential fraud/scams or misuse of personal information. This process is implemented to safeguard both the credit card owner and sellers from fraudulent activities.

All collected information will be used strictly for identification purposes. If customers decline to provide the necessary information, we reserve the right to cancel the order. KICKS CREW retains the right to cancel any order without prior notification to the customer if suspicious activity is identified with the payment information.

Dispute

If you dispute any transaction made on the KICKS CREW website or app, your order may be placed on hold until the dispute is resolved. You agree not to attempt to evade or circumvent any refund prohibitions regarding products purchased from KICKS CREW.

Except as provided under our Return policy, you agree not to dispute or seek a chargeback from the payment provider used for your purchase. If you initiate a chargeback, your order may be canceled, and KICKS CREW reserves the right, at our sole discretion, to refuse future purchases from any account associated with the chargeback.

Order Processing and Delivery Times

Order processing times may vary depending on size selection, seller fulfillment, product availability, order volume, and quality control. External factors beyond our control may also affect processing times.

Tracking numbers are usually provided within 7-10 business days of order placement. In some cases, KICKS CREW may take up to 30 days to receive, review, and ship an item due to weather-related delays, courier limitations, or other unforeseen circumstances.

Please note that order processing time and order delivery time are separate stages. Order Processing Time refers to the time it takes for us to prepare your item(s) for shipment, including order verification, quality checks, and packaging. This timeframe does not include Order Delivery Time, which begins once the item(s) have been dispatched from our facility to the final delivery address.

Estimated delivery times are based on the carrier's schedule and are in addition to the processing time. Delivery times may vary due to factors beyond our control, including customs clearance, shipping delays, or other logistical issues.

Delivery

Shipping addresses cannot be modified after the order has been placed or dispatched. Please ensure all shipping information, including name, address, and phone number, is accurate. As the shipping address is provided by the customer, any delivery failure arising from incorrect information is outside of our control and responsibility, and KICKS CREW shall not be held liable for any resulting issues or additional costs. For further assistance, please contact the local courier directly.

Deliveries are made by third-party couriers contracted by us, and a signature may be required upon delivery. All delivery times are estimates and are not guaranteed. Shipments may be affected by weather-related delays, courier limitations, or other force majeure events.

Once the package is handed over to the courier,  the order is considered complete, and any updates depend on the courier. KICKS CREW will not be responsible for package loss or damage caused by courier mishandling. In case of loss or damage, we will assist in filing a claim with the courier, but the compensation is subject to the courier’s determination.

Customers are responsible for complying with all applicable laws and regulations of the country for which the product(s) are destined. We will not be liable for any breach of any such laws by you.

Shipping fees are non-refundable in all cases of delivery failure. If an order cannot be delivered, it may be discarded by local customs or returned to us, and applicable surcharges may apply. If a shipment is returned to us due to delivery failure, a refund will be processed in accordance with our Return Policy, with deductions for any applicable return surcharges, taxes, and duties incurred. If these charges exceed the total value of the order, or if the order cannot be returned to us (e.g., discarded, destroyed, or missing), no refund will be issued.

Cancellations

Cancellation requests are not guaranteed and depend on the status of your order. Additionally, a cancellation fee of 25% of the product price will apply to all approved cancellations. To request a cancellation, please visit our CONTACT US page.

Return and Exchange

All return and exchange requests must be initiated within 14 days of the delivery date, as indicated by the shipment tracking information.

Customers must CONTACT KICKS CREW and receive prior confirmation before returning any product. Returns without authorization will be considered invalid and may be rejected.

We recommend recording the unboxing process from the outer packaging to show the item’s condition upon receipt. Insufficient documentation may affect claim eligibility.

Eligibility & Condition Standards

To qualify for a return or exchange, all items must be returned in the exact condition in which they were received.

  • Unworn, unused, and undamaged
  • All original tags attached, including the KICKS CREW tags
  • All original accessories and packaging included, including the original shoe box (if applicable)
  • Products must be returned in their original boxes and placed inside protective outer packaging. Do not attach labels, tape, or markings directly to the shoebox or clothing packaging
  • Customers are strongly advised to use a trackable shipping service for all returns

The following items are strictly non-returnable and non-exchangeable:

  • Items submitted outside the applicable return or exchange window
  • Trading Cards & Collectibles
  • Altered Items (worn, used, damaged, or with tags removed/detached)
  • Items with damaged, missing, or non-original packaging, including shoe boxes or apparel packaging
  • Promotional items, including but not limited to Final Sale products, "$1 Deals," and marketing giveaways

KICKS CREW reserves the right, at its sole discretion, to determine the eligibility of all returned items. Items that do not meet these requirements will be rejected and returned to the customer at their expense.

Size Exchange

KICKS CREW offers a one-time size exchange, subject to availability and will be confirmed after the item is successfully returned. The following costs apply:

  • Price Difference: Any price difference between the original item and the replacement size, including applicable taxes.
  • Return Shipping Fee: Customers are responsible for the shipping cost to return the original item
  • Reshipping Fee: Customers are responsible for the shipping cost to have the replacement item sent to the delivery address provided.
  • Original Shipping Fee: The shipping fee paid for the original order is non-refundable.

Any import duties, taxes, or customs fees incurred during the original shipment or the exchange process are determined by local customs authorities and are solely the customer’s responsibility. These fees are not refundable or transferable through KICKS CREW.

Return

If you choose to return an item for a refund or store credit rather than exchange, the following costs apply:

  • Restocking Fee: 15% restocking fee based on the original total order value to cover the operational costs of return processing, authentication, and quality verification.
  • Original Shipping Fee: The original shipping fee is non-refundable.
  • Return Shipping Fee: Customers are responsible for the shipping cost to return the item.

Any import duties, taxes, or customs fees incurred are determined by local customs authorities and are solely the customer's responsibility. These fees are not refundable or transferable through KICKS CREW.

Refund Methods (Returns)

Refund methods are determined by the shipping destination and applicable local regulations:

  • United States Orders: Approved returns are refunded in the form of Store Credit, which can be used immediately toward a future purchase on KICKS CREW. Store Credit is non-transferable and does not expire.
  • International Orders: For all other regions, and where required by applicable law, customers may choose one of the following refund methods:
    • Store Credit
    • Refund to the Original Payment Method

Refunds are processed after the returned item has been received, inspected, and approved.

Defective, Damaged, or Incorrect Items

If you receive an item that is defective, damaged, incorrect, or materially different from the item description on our website, you must contact KICKS CREW within 7 days of the delivery date.

To be eligible for review, the item and all shipment contents must remain in their original condition upon delivery, including:

  • Original outer packaging
  • Original product packaging/shoebox
  • Product in unused condition with the KICKS CREW verification tag attached, and the original brand tags attached

To assist with the investigation and verification process, customers are required to provide a complete unboxing video showing:

  • The unopened parcel prior to opening
  • The shipping label
  • The unpacking process
  • The item and its condition upon receipt

Claims that do not meet the requirements above, including claims submitted after the 7-day reporting period or without the required verification materials, may be declined.

Sales Tax

For shipments to Australia and the United States, Sales Tax is included in the final price. However, customers remain responsible for any applicable import duties and customs fees. The taxes collected will be remitted to the appropriate taxing authorities. In jurisdictions where we do not collect taxes, buyers may be responsible for remitting taxes directly to the relevant authorities, as required by local laws.

Sales Tax is applied based on the buyer’s shipping address, not the billing address. Tax rates may vary by location, and some jurisdictions may include shipping fees in the calculation of Sales Tax, while others may not.

It is important to note that import duties and customs fees may vary depending on the destination country's regulations. Customers are advised to familiarize themselves with their country's import regulations to understand any potential duties, taxes, or customs fees they may incur upon receipt of their order.

Import Duty and Custom Fee

We ship to most countries on a DDU (Delivery Duty Unpaid) basis. This means that the prices displayed on our site are exclusive of all taxes, duties, and customs fees. Customers are responsible for paying any import duties and customs fees upon delivery.

Your order may be subject to import duties and customs fees upon delivery to the specified destination. You will be responsible for payment of any such import duties and customs fees. These charges are determined by local customs authorities, and we cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please ensure compliance with all applicable laws and regulations in the destination country. We are not liable for any breaches. Additionally, note that sales tax, import duties, and customs fees are non-refundable.

Accounts, Passwords, and Security

You may be required to create an account to access certain features of the KICKS CREW website and services. Account creation requires a valid email address and password, or you can use social media login tools provided on the site. To purchase products, you must have a valid payment method, such as a credit card or other approved payment methods, on file with our third-party payment processors.

By registering, you agree to provide accurate information and must not register using a false name or unauthorized payment method. You are responsible for maintaining your account's confidentiality and password and restricting access to your account. You agree to accept responsibility for all activities conducted under your account or password.

If you become aware of any unauthorized use of your account, password, or other security breach, please contact us immediately. You may be held liable for losses incurred by KICKS CREW or others due to unauthorized account use.

You are not permitted to use another person’s account without their explicit permission. Additionally, accounts are non-transferable and cannot be assigned to others.

Account Deactivation

Please be advised that all account deactivations are irreversible and permanent. Once your account has been successfully deleted, you can no longer access any associated information, products, or services.

It is important to note that account deactivation is not permitted if you have pending orders or previous purchases with us. By deactivating your account, you agree to indemnify and hold harmless KICKS CREW from any claims, losses, liabilities, damages, costs, and expenses arising from or related to the deactivation of your account.

Gift Card

  • All gift card codes apply to the total payment of the order, including shipping fees.
  • If the payment amount is lower than the gift card value, the remaining balance can be used for future purchases.
  • Invalid or unidentifiable gift card codes will not be redeemed.
  • The value of gift cards is non-convertible into cash.
  • The value of the gift card does not expire, and no fees apply.
  • Neither KICKS CREW nor the gift card issuer is responsible for any lost or stolen gift cards or unauthorized use. Please keep the gift card secure and do not share it with anyone, as it can be redeemed by anyone who finds it.
  • The gift card may only be used to make purchases up to the available balance. Additional payment will be required if the product price exceeds the gift card's value. Some items may not be available for purchase. You agree that we are not responsible if you do not have sufficient funds on your gift card to complete a transaction.
  • If an order paid with a gift card is eligible for a refund, any refund amount will first be applied to the original gift card up to the amount used. Any remaining balance, if applicable, will then be refunded to the original payment method used for the transaction (such as a credit card or other form of payment). Please note that gift card refunds will be processed according to our standard refund timeline and are subject to any restocking fees or applicable deductions as outlined in our Return Policy. 
  • Please note that gift cards are not for resale.
  • Gift cards are intended for personal use only and may not be used for commercial purposes.
  • Gift cards cannot be used to purchase additional gift cards.
  • The use of gift cards is subject to our standard terms and conditions, including our privacy policy.
  • We reserve the right to correct the gift card balance in the event of a clerical, billing, or accounting error. You also agree that we may deactivate, cancel, or suspend any gift card and freeze associated funds if we suspect fraud, unlawful activity, or improper gift card use. You agree not to use a revoked gift card.
  • Any disputes regarding gift card usage will be resolved at the discretion of KICKS CREW.
  • KICKS CREW reserves the right to modify or discontinue the gift card program at any time without prior notice.

International Transaction Fee

Certain banks and payment gateways may impose additional charges for currency conversion rates or foreign purchase fees when processing transactions. KICKS CREW is not responsible for any such fees incurred. These charges are determined solely by your bank or payment provider, and KICKS CREW has no control over them. If you have any inquiries or concerns regarding these additional charges, please contact your respective bank or payment solution company directly for further information.

Liability Limitation

Any liability we may have for losses incurred by you arising from any order shall not exceed the purchase price of the relevant product(s) and is strictly limited to reasonably foreseeable losses. Losses are foreseeable where they could be reasonably contemplated by both parties at the time we accept your order. We shall not be liable or responsible for any failure to perform or delay in the performance of any order caused by events beyond our reasonable control.

Termination

KICKS CREW reserves the right, in its sole discretion, to terminate your use of the Site and any rights provided to you under these terms at any time, without prior notice, and to deny you access to the Site for any reason or no reason at all, at its sole discretion.

Upon termination, you are required to promptly destroy all materials downloaded or otherwise obtained from this Site and any copies of such materials in your possession.

Furthermore, termination of your access to the Site does not relieve you of any obligations arising under these terms prior to termination, including but not limited to any outstanding payment obligations or restrictions on the use of intellectual property.

You agree that KICKS CREW shall not be liable to you or any third party for any termination of your access to the Site.

Governing Law

The terms & conditions and payments of KICKS CREW LLC are governed by the laws of the USA.
